Three Court of Appeal Judges this afternoon nullified the election of Fred Outa as the Member of Parliament for Nyando Constituency in Kisumu County.
In a ruling read by Justice Festus Azangalala on behalf of Justices; Phillip Waki and David Maranga; the judges declared that their decision was based on the ground that Outa’s nomination was not fair as argued by his main rival Jared Okello.
Azangalala also stated that the nullification was as a result of bribery by virtue of being the Patron of Nyando Constituency Development fund (CDF) and his officials who used the facility to campaign for Outa against the Election rules and regulations.
It emerged before the court that some CDF officials campaigned for Outa through a series of CDF Cheque disbursements.
As a result, the three bench judge declared that the IEBC conduct fresh elections in Nyando.
When reached for comment, Jared Okello said this was a golden opportunity provided by God for Nyando electorate to choose a new MP.
“Nyando electorates now have another chance to elect their new MP following the court ruling and I am ready to embark on fresh campaigns to win the seat,” he declared.
Outa could not be reached for comment as he did not even turn up in court for the ruling.
Following the nullification of Outa as the MP for Nyando, there was jubilation by supporters of his rivals who thronged the court precincts with others shouting Halleluya! God is great. He has answered our prayers!
Meanwhile, a section of supporters of the former MP left the court a dejected lot and almost caused a fracas soon after the ruling but hawkeyed police officers acted swiftly to avert the crisis.
