Kericho man gets five years for attempting to rape terminally sick granny
A 21-year-old man who attempted to rape a 70-year-old terminally ill granny after he failed to get paid his debt has been sentenced to five years in jail by a Kericho court after pleading guilty to the offense.
Kenneth Kipkoech Langat alias ‘Marende’ appeared before Kericho Resident Magistrate Benjamin Bryson Limo charged that on 1 November 2017 at Kimwogit village, Cheborge location in Bureti sub-county within Kericho County he attempted to rape a 70-year-old woman without her consent.
The prosecution told the court on Friday that on the material day the complainant was in her house with her granddaughter but later sent her on an errand to a neighbour’s house.
The accused arrived at the complainant’s house and demanded to know if her husband was present upon which the complainant struggled to answer. The accused retorted back that he had come to collect his debt from her husband.
The accused then grabbed the complainant by the upper arm and dragged her to the next room where there was bed and started to remove her inner clothes.
The complainant managed to struggle with the accused but due to lack of strength she tried to raise alarm and her granddaughter rushed to the house only to find the accused wrestling down her grandmother.
The complainant’s granddaughter rushed outside and alerted two of their neighbours who arrived at the house and confronted the accused but he managed to escape.
The complainant was rushed to Litein mission hospital for examination and was later discharged after receiving treatment.
The matter was reported at Litein police station and police traced the accused who was arrested and charged with the offense. A P3 form tabled before the court as exhibit in the case indicated the degree of injury as bodily harm. The document further revealed the complainant was terminally sick with stage 4 breast cancer.
The 70-year-old grandmother sustained injuries on her upper arms and had a swollen right hand.
In his ruling, Limo said the accused was sentenced to serve five years in jail as per the law. The court gave the accused 14 days to file an appeal.
